Ce territoire a \u00e9t\u00e9 le th\u00e9\u00e2tre d&rsquo;une guerre de 13 mois entre Isra\u00ebl et le Hamas, ayant caus\u00e9 la mort de plus de 44 000 personnes et bless\u00e9 plus de 104 000 autres.<\/p>\n\n\n\n<p><strong>R\u00e9actions contrast\u00e9es aux mandats d&rsquo;arr\u00eat<\/strong><\/p>\n\n\n\n<p>Le Premier ministre isra\u00e9lien Benjamin Netanyahu a vivement rejet\u00e9 ces accusations, qualifiant les actions de la CPI d\u2019\u00a0\u00bbabsurdes et fausses\u00a0\u00bb et les condamnant avec \u00ab\u00a0d\u00e9go\u00fbt\u00a0\u00bb. Isra\u00ebl, qui ne reconna\u00eet pas la juridiction de la CPI, consid\u00e8re ces mandats comme une ing\u00e9rence politique et juridique.<\/p>\n\n\n\n<p>De son c\u00f4t\u00e9, le Hamas a accueilli favorablement les mandats contre Netanyahu et Gallant, qu\u2019il d\u00e9crit comme une reconnaissance des d\u00e9cennies d\u2019injustice subies sous une \u00ab\u00a0occupation fasciste\u00a0\u00bb. Toutefois, l\u2019organisation n\u2019a pas comment\u00e9 le mandat visant Mohammed Deif, que Isra\u00ebl affirme avoir tu\u00e9 lors d\u2019une frappe a\u00e9rienne.<\/p>\n\n\n\n<p>Le mandat contre Deif repose sur des accusations de meurtre, de viol, de torture et de prise d\u2019otages, des actes qualifi\u00e9s de crimes de guerre et de crimes contre l\u2019humanit\u00e9, li\u00e9s notamment aux attaques du Hamas du 7 octobre 2023 sur le territoire isra\u00e9lien. Ces attaques avaient entra\u00een\u00e9 la mort de quelque 1 200 personnes, majoritairement des civils, et l\u2019enl\u00e8vement de 250 autres.<\/p>\n\n\n\n<p><strong>Des all\u00e9gations graves contre Isra\u00ebl et le Hamas<\/strong><\/p>\n\n\n\n<p>La CPI accuse Netanyahu et Gallant d\u2019\u00eatre co-auteurs de crimes de guerre, notamment l\u2019utilisation de la famine comme m\u00e9thode de guerre. Les all\u00e9gations incluent la privation de nourriture, d\u2019eau, d\u2019\u00e9lectricit\u00e9 et de soins m\u00e9dicaux pour les habitants de Gaza, cr\u00e9ant des conditions ayant entra\u00een\u00e9 la mort d\u2019enfants et de civils par malnutrition et d\u00e9shydratation.<\/p>\n\n\n\n<p>Bien que ces mandats d\u2019arr\u00eat compliquent potentiellement les d\u00e9placements internationaux de Netanyahu et Gallant, leur comparution devant la CPI semble peu probable dans l\u2019imm\u00e9diat. La CPI, qui ne dispose pas d\u2019une force d\u2019ex\u00e9cution, d\u00e9pend de la coop\u00e9ration des \u00c9tats membres pour arr\u00eater les suspects.<\/p>\n\n\n\n<p><strong>Le r\u00f4le de la CPI dans les conflits internationaux<\/strong><\/p>\n\n\n\n<p>La Cour p\u00e9nale internationale, cr\u00e9\u00e9e en 2002, vise \u00e0 poursuivre les individus responsables de crimes de guerre, de crimes contre l\u2019humanit\u00e9, de g\u00e9nocide et d\u2019agression, lorsque les juridictions nationales sont incapables ou refusent de le faire. Cependant, plusieurs pays, dont Isra\u00ebl, les \u00c9tats-Unis, la Russie et la Chine, ne reconnaissent pas son autorit\u00e9.<\/p>\n\n\n\n<p>Avec cette d\u00e9cision, la CPI place une fois de plus le droit international au c\u0153ur des d\u00e9bats sur les responsabilit\u00e9s dans les conflits modernes. Toutefois, l\u2019efficacit\u00e9 de ces mandats d\u2019arr\u00eat d\u00e9pendra largement de la volont\u00e9 des acteurs internationaux de faire respecter ses d\u00e9cisions.<\/p>\n\n\n\n<p><strong>Un pr\u00e9c\u00e9dent historique<\/strong><\/p>\n\n\n\n<p>Ce d\u00e9veloppement met en lumi\u00e8re la complexit\u00e9 du conflit isra\u00e9lo-palestinien et soul\u00e8ve des questions sur l\u2019\u00e9quilibre entre la justice internationale et les dynamiques politiques. Les accusations port\u00e9es contre Netanyahu, Gallant et Deif rappellent que la CPI cherche \u00e0 attribuer des responsabilit\u00e9s individuelles pour des actes commis dans des contextes de guerre
