Un mandat d’arr\u00eat international \u00e0 l’encontre du pr\u00e9sident Vladimir Poutine ouvre la perspective que l’homme dont le pays a envahi l’Ukraine soit traduit en justice, mais il complique les efforts visant \u00e0 mettre fin \u00e0 cette guerre dans le cadre de pourparlers de paix.<\/p>\n\n\n\n

La justice et la paix semblent n’\u00eatre que de lointaines possibilit\u00e9s aujourd’hui, et la relation conflictuelle entre les deux est un dilemme au c\u0153ur de la d\u00e9cision prise le 17 mars par la Cour p\u00e9nale internationale de demander l’arrestation du dirigeant russe.<\/p>\n\n\n\n

Les juges de La Haye ont estim\u00e9 qu’il existait des \u00ab\u00a0motifs raisonnables de croire\u00a0\u00bb que M. Poutine et son commissaire aux droits de l’enfant \u00e9taient responsables de crimes de guerre, en particulier de la d\u00e9portation et du transfert ill\u00e9gaux d’enfants des zones occup\u00e9es de l’Ukraine vers la Russie.<\/p>\n\n\n\n

Aussi improbable que puisse para\u00eetre aujourd’hui la pr\u00e9sence de Poutine dans une salle d’audience de La Haye, d’autres dirigeants ont \u00e9t\u00e9 traduits en justice devant des tribunaux internationaux.<\/p>\n\n\n\n

L’ancien homme fort de la Serbie, Slobodan Milosevic, moteur des guerres balkaniques des ann\u00e9es 1990, a \u00e9t\u00e9 jug\u00e9 pour crimes de guerre, y compris pour g\u00e9nocide, par un tribunal des Nations unies \u00e0 La Haye apr\u00e8s avoir perdu le pouvoir. Il est mort dans sa cellule en 2006 avant qu’un verdict n’ait pu \u00eatre rendu.
La Serbie, qui souhaite adh\u00e9rer \u00e0 l’Union europ\u00e9enne mais qui a conserv\u00e9 des liens \u00e9troits avec la Russie, est l’un des pays qui ont critiqu\u00e9 l’action de la CPI.
